{"id":13898,"date":"2025-07-02T17:03:32","date_gmt":"2025-07-02T23:03:32","guid":{"rendered":"https:\/\/staytv.net\/?p=13898"},"modified":"2025-07-02T17:03:32","modified_gmt":"2025-07-02T23:03:32","slug":"sala-iv-rechaza-de-plano-accion-contra-extradicion-de-celso-gamboa-y-otros-costarricenses","status":"publish","type":"post","link":"https:\/\/staytv.cr\/index.php\/2025\/07\/02\/sala-iv-rechaza-de-plano-accion-contra-extradicion-de-celso-gamboa-y-otros-costarricenses\/","title":{"rendered":"SALA IV RECHAZA DE PLANO ACCI\u00d3N CONTRA EXTRADICI\u00d3N DE CELSO GAMBOA Y OTROS COSTARRICENSES"},"content":{"rendered":"<p data-start=\"193\" data-end=\"437\"><strong data-start=\"193\" data-end=\"226\">San Jos\u00e9, 2 de julio de 2025.<\/strong> \u2014 La Sala Constitucional (Sala IV) rechaz\u00f3 de plano la acci\u00f3n de inconstitucionalidad que pretend\u00eda frenar los procesos de extradici\u00f3n contra ciudadanos costarricenses, entre ellos el exmagistrado Celso Gamboa.<\/p>\n<p data-start=\"439\" data-end=\"660\">Seg\u00fan inform\u00f3 el Poder Judicial, la acci\u00f3n fue desestimada por una mayor\u00eda del Tribunal Constitucional debido a que no cumpl\u00eda con requisitos formales esenciales. En concreto, el recurso fue declarado improcedente porque:<\/p>\n<ul data-start=\"662\" data-end=\"964\">\n<li data-start=\"662\" data-end=\"747\">\n<p data-start=\"664\" data-end=\"747\">No se acredit\u00f3 la legitimaci\u00f3n activa por parte del abogado que present\u00f3 la acci\u00f3n.<\/p>\n<\/li>\n<li data-start=\"748\" data-end=\"881\">\n<p data-start=\"750\" data-end=\"881\">El escrito carec\u00eda de una fundamentaci\u00f3n clara contra los art\u00edculos impugnados de la Ley de Extradici\u00f3n y el tratado internacional.<\/p>\n<\/li>\n<li data-start=\"882\" data-end=\"964\">\n<p data-start=\"884\" data-end=\"964\">No se cumpli\u00f3 con el requisito de plantear un conflicto constitucional concreto.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"966\" data-end=\"1332\">El expediente rechazado, registrado bajo el n\u00famero 25-018436-0007-CO, intentaba cuestionar la reforma constitucional recientemente aprobada, que permite la extradici\u00f3n de costarricenses en casos de crimen organizado, narcotr\u00e1fico y terrorismo. Sin embargo, la Sala no entr\u00f3 a conocer el fondo del asunto debido a los vicios procesales detectados en el planteamiento.<\/p>\n<p data-start=\"1334\" data-end=\"1656\">La reforma en cuesti\u00f3n fue promulgada mediante la Ley 10.730 y autoriz\u00f3 por primera vez en la historia del pa\u00eds la extradici\u00f3n de nacionales, eliminando la prohibici\u00f3n que exist\u00eda en el art\u00edculo 32 de la Constituci\u00f3n Pol\u00edtica. Esta modificaci\u00f3n fue aprobada por la Asamblea Legislativa y respaldada por el Poder Ejecutivo.<\/p>\n<p data-start=\"1658\" data-end=\"1923\">Con este fallo, se despeja el camino legal para que contin\u00faen los procesos de extradici\u00f3n solicitados por los Estados Unidos contra varios ciudadanos, entre ellos Gamboa, quien fue capturado por presuntos v\u00ednculos con estructuras de narcotr\u00e1fico y lavado de dinero.<\/p>\n<p data-start=\"1925\" data-end=\"2043\">La resoluci\u00f3n fue comunicada este martes por el Poder Judicial y actualmente se encuentra en etapa de redacci\u00f3n final.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>San Jos\u00e9, 2 de julio de 2025. \u2014 La Sala Constitucional (Sala IV) rechaz\u00f3 de plano la acci\u00f3n de inconstitucionalidad que pretend\u00eda frenar los procesos de extradici\u00f3n contra ciudadanos costarricenses, entre ellos el exmagistrado Celso Gamboa.
