La <strong>Ley 10126<\/strong> autoriza a las municipalidades a permitir que ciertos negocios usen aceras, plazas y otros espacios p\u00fablicos. El objetivo es que m\u00e1s personas disfruten la ciudad, sin perder el orden ni la accesibilidad en las v\u00edas.<\/p>\n<p>La Ley de <strong>Comercio al Aire Libre<\/strong> no abre la puerta al desorden ni al comercio informal. M\u00e1s bien, fija condiciones claras para que el Comercio al Aire Libre se d\u00e9 solo donde hay un local formal, con patente y permisos al d\u00eda. Todo bajo control municipal.<\/p>\n<h2>\u00bfQui\u00e9n puede hacer Comercio al Aire Libre?<\/h2>\n<p>El <strong>Comercio al Aire Libre<\/strong> no es para vendedores ambulantes. Solo pueden solicitarlo:<\/p>\n<ul>\n<li>Restaurantes, caf\u00e9s, bares u otros comercios con patente municipal vigente.<\/li>\n<li>Negocios que tengan su local en propiedad privada y que est\u00e9 junto al espacio p\u00fablico que quieren usar.<\/li>\n<\/ul>\n<p>Es decir, el Comercio al Aire Libre funciona como una extensi\u00f3n del local hacia la acera, la plaza o el parque que queda al frente.<\/p>\n<h2>\u00bfQu\u00e9 se puede colocar en el espacio p\u00fablico?<\/h2>\n<p>La <strong>Ley 10126<\/strong> permite <strong>Comercio al Aire Libre<\/strong> con mobiliario liviano:<\/p>\n<ul>\n<li>Mesas<\/li>\n<li>Sillas<\/li>\n<li>Sombrillas<\/li>\n<li>Otros elementos similares de apoyo<\/li>\n<\/ul>\n<p>Ese mobiliario debe retirarse al final de la jornada. No se autorizan construcciones fijas ni cerramientos que bloqueen el paso. El espacio sigue siendo p\u00fablico, aunque tenga mesas de Comercio al Aire Libre.<\/p>\n<h2>Reglas b\u00e1sicas para el Comercio al Aire Libre<\/h2>\n<p>Para que el <strong>Comercio al Aire Libre<\/strong> funcione sin conflictos, la Ley 10126 exige que cada municipalidad emita un reglamento propio. En esos reglamentos se definen, entre otros puntos:<\/p>\n<ul>\n<li>Horarios para el Comercio al Aire Libre.<\/li>\n<li>Tipo y tama\u00f1o del mobiliario permitido.<\/li>\n<li>Ancho m\u00ednimo libre para el paso de peatones y personas con discapacidad.<\/li>\n<li>Normas de limpieza, ruido, rotulaci\u00f3n e iluminaci\u00f3n.<\/li>\n<li>Plazos de la licencia y causales de revocatoria.<\/li>\n<\/ul>\n<p>La autorizaci\u00f3n es temporal y precaria. No crea propiedad ni posesi\u00f3n sobre la acera o la plaza. Si el comercio incumple las reglas, la municipalidad puede cancelar el permiso de Comercio al Aire Libre.<\/p>\n<h2>\u00bfCu\u00e1nto se paga por Comercio al Aire Libre?<\/h2>\n<p>El uso de espacio p\u00fablico para <strong>Comercio al Aire Libre<\/strong> no es gratis. El negocio debe pagar a la municipalidad un canon:<\/p>\n<ul>\n<li>El monto se fija en el reglamento local.<\/li>\n<li>Normalmente se calcula por metro cuadrado de espacio autorizado.<\/li>\n<li>El canon no puede superar el 50 % de lo que ya se paga por la patente del negocio.<\/li>\n<\/ul>\n<p>Los ingresos generados por el Comercio al Aire Libre deben invertirse en mejorar el espacio p\u00fablico. As\u00ed, mesas y sillas no solo ayudan a los comercios, tambi\u00e9n ayudan a cuidar y embellecer calles, plazas y parques.<\/p>\n<h2>Beneficios y l\u00edmites del Comercio al Aire Libre<\/h2>\n<p>El <strong>Comercio al Aire Libre<\/strong> ofrece varios beneficios:<\/p>\n<ul>\n<li>Da m\u00e1s aforo a locales que tienen interiores peque\u00f1os.<\/li>\n<li>Hace las calles m\u00e1s activas y seguras, con gente usando el espacio p\u00fablico.<\/li>\n<li>Aporta ingresos extra a los municipios para mantenimiento urbano.<\/li>\n<\/ul>\n<p>Pero la <strong>Ley 10126<\/strong> tambi\u00e9n marca l\u00edmites claros:<\/p>\n<ul>\n<li>No se permite Comercio al Aire Libre que bloquee el libre tr\u00e1nsito.<\/li>\n<li>No se autoriza comercio informal sin local fijo.<\/li>\n<li>No se permiten estructuras permanentes sobre el espacio p\u00fablico.<\/li>\n<\/ul>\n<p>El mensaje es claro: el Comercio al Aire Libre es bienvenido, siempre que respete la ciudad y a quienes la usan.<\/p>\n<p>En resumen, el <strong>Comercio al Aire Libre<\/strong> regulado por la <strong>Ley 10126<\/strong> es una herramienta para que restaurantes, caf\u00e9s y bares de Costa Rica salgan a la calle de forma ordenada. Las municipalidades controlan d\u00f3nde, c\u00f3mo y cu\u00e1nto se puede usar el espacio p\u00fablico.
