El primer proyecto de ley de este paquete estrat\u00e9gico plantea una reforma profunda al C\u00f3digo Procesal Penal con el objetivo principal de sustituir la tradicional audiencia preliminar por una \u00fanica audiencia previa al juicio, concentrando de esta manera todo el control de la acusaci\u00f3n en una sola fase procesal. Esta propuesta surge para dar respuesta directa a una realidad cr\u00edtica que afecta el sistema de justicia del pa\u00eds, donde los procesos judiciales se extienden por largos per\u00edodos, generando graves distorsiones en la recolecci\u00f3n de pruebas y en la memoria de los testigos que participan en las causas penales.<\/p>\n<p>Durante la presentaci\u00f3n oficial de las iniciativas de ley, las autoridades del Gobierno explicaron que el sistema penal actual padece de una morosidad insostenible que perjudica directamente a las v\u00edctimas y a la sociedad en general. La acumulaci\u00f3n de etapas procesales innecesarias provoca que transcurran demasiados a\u00f1os entre la comisi\u00f3n del presunto delito y la realizaci\u00f3n efectiva del debate oral y p\u00fablico. Como consecuencia directa de esta excesiva lentitud, testigos en causas penales muy delicadas han manifestado ante los estrados judiciales que el tiempo transcurrido es tan prolongado que los hechos materiales se desvanecen de su memoria, restando solidez probatoria a los expedientes y debilitando la efectividad de la persecuci\u00f3n penal en el territorio nacional.<\/p>\n<h2>La urgencia de simplificar el proceso y eliminar tr\u00e1mites duplicados<\/h2>\n<p>El n\u00facleo fundamental de la propuesta legislativa radica en erradicar la burocracia, los procedimientos redundantes y las diversas etapas que duplican funciones dentro del aparato judicial. Al concentrar el control de la acusaci\u00f3n en una \u00fanica audiencia previa al juicio, se pretende agilizar de forma dr\u00e1stica el curso de las causas penales que congestionan los despachos. Esta simplificaci\u00f3n procedimental no solo busca una reducci\u00f3n significativa en los tiempos totales que demanda cada expediente, sino que tambi\u00e9n apunta a una disminuci\u00f3n sustancial en los costos operativos asumidos por el Poder Judicial, optimizando de manera eficiente los recursos p\u00fablicos disponibles para la administraci\u00f3n de justicia.<\/p>\n<p>Desde la perspectiva del Ejecutivo, el planteamiento no busca en ning\u00fan momento menoscabar las garant\u00edas fundamentales de los ciudadanos, sino hacer mucho m\u00e1s eficiente el sistema sin descuidar los principios constitucionales b\u00e1sicos. La reforma est\u00e1 cuidadosamente dise\u00f1ada bajo la premisa de garantizar en todo momento el respeto absoluto al debido proceso y al derecho de defensa que asiste por ley a toda persona que deba enfrentar una causa judicial en los tribunales del pa\u00eds, asegurando un equilibrio entre la celeridad y la seguridad jur\u00eddica.<\/p>\n<h3>Eficiencia procesal y respeto absoluto al debido proceso<\/h3>\n<p>Los promotores de la iniciativa enfatizaron que el enfoque principal de esta modificaci\u00f3n legal es anteponer las necesidades leg\u00edtimas de las v\u00edctimas y de la ciudadan\u00eda, la cual se encuentra profundamente deseosa de que se haga justicia de manera oportuna. Lejos de proponer un incremento desmedido de recursos financieros sin control fiscal, la estrategia gubernamental se centra en la optimizaci\u00f3n de los flujos de trabajo internos, corrigiendo aquellas deficiencias estructurales que han propiciado la impunidad y la persistente percepci\u00f3n de lentitud en el sistema judicial costarricense.<\/p>\n<p>Con la implementaci\u00f3n de esta audiencia \u00fanica, el Estado costarricense aspira a modernizar su marco normativo procesal, aline\u00e1ndose firmemente con las exigencias internacionales de eficacia y celeridad.
